GROUNDS FOR USING AND PROCESSING YOUR DATA

The information I collect and store is used primarily to allow me to offer goods and services for sale. In addition, I may collect, use, and process your information based on the following grounds:

LEGITIMATE BUSINESS INTERESTS

I may use and process your data for my legitimate business interests, which include, among other things, communicating with you, improving my goods or services, improving my website, and providing you with the information or products you have requested.

Performance of a Contract: I may use and process your information to enter into a contract with you and to fulfill my contractual obligations to you.

Consent: I may use your data, or allow selected third parties to use your data, based on your consent to my use and sharing of that data. You can withdraw your consent at any time, but doing so may affect your ability to use my website or other offerings.

As Required by Law: I may also use or process your data as needed to comply with legal obligations.

WHY WE DISCLOSE YOUR INFORMATION

I may share your information with third parties in certain situations. In particular, I may share your data with third-party processors as needed to serve my legitimate business interests, which include managing my website, administering your account, entering into contracts with you, communicating with you, processing orders for goods or services, delivering those goods and services, identifying trends, protecting the security of my business and website, and marketing additional products and services to you. The legal basis for disclosing your data is both your consent to this Privacy Policy and my right to protect and promote my legitimate business interests.

Here are specific reasons why I may share your information:

Third-Party Processing: I may disclose your information to third parties who assist me with various tasks such as payment processing, hosting services, email delivery, communications, and customer service. I do not always disclose these third-party processors unless required by law. They are not authorized to use or disclose your personal information except in connection with providing their services to me.

By Law: I may share your data when required by law or to respond to legal processes, including subpoenas, or when necessary to protect the rights, property, and safety of others. This includes sharing information with others to prevent or address fraud and to avoid credit risks.

To Protect My Business: I may use your information to protect my business, including investigating and addressing any violations of my rights or policies. I may also disclose your information as reasonably necessary to acquire and maintain insurance coverage, manage risks, obtain financial or legal advice, or to exercise or defend legal claims.

Business Transfers: In the unlikely event that my business undergoes a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction, I may transfer or share your data as part of that process. In such cases, customer information is considered a business asset that may be acquired by a third party. You acknowledge that these business transfers may happen and that your personal information may continue to be stored, used, or processed as described in this Privacy Policy.

Affiliates: I may share your personal information with my business affiliates who promote my products or services for a commission. I require my affiliates to honor this Privacy Policy. They are not allowed to spam you and must disclose their affiliate status. If an affiliate fails to comply, they are in violation of their terms and this Privacy Policy. Any such violations should be reported to tracy@tracyinman.com.

Please note that at this time, I do not recognize automated browser signals regarding tracking systems, including any “do not track” instructions.

Other Third Parties: I may share information with advertisers, investors, or other third parties for the purpose of conducting general business analysis. If I do so, I will make reasonable efforts to inform you if required by law.

Interaction With Others: If you interact with others on my website or mobile app, such as participating in group chats or online courses, other users may have access to some of your data, including your name, profile picture, and your history of interaction with my website, such as prior comments or posts.

Online Postings: When you post online, your posts may be viewed by others, and I may distribute your comments outside of the website.

External Links: My website may include hyperlinks to other websites that I do not control. I suggest you exercise caution when clicking on these links. Although I take reasonable care when including hyperlinks on my website, I do not regularly monitor the websites of third parties and am not responsible for any damage or consequences you may suffer by using these links. I am not bound by the privacy policies of any third-party websites you access through hyperlinks, and those sites are not bound by mine. I encourage you to read the privacy policies of those third-party websites before interacting with them or making purchases. They may collect different information and use different methods than I do.

Other Purposes: I may disclose your personal data as necessary to comply with legal obligations or to protect your interests, the vital interests of others, or my business.

TRACKING TECHNOLOGIES

Log Files: Like many websites, I use log files. These files log visitors to the site and are a standard part of hosting services’ analytics. The information in the log files may include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamps, referring and exit pages, and possibly the number of clicks. I use this information to analyze trends, manage the site, track users’ movement around the site, and gather demographic information. IP addresses and other such data are not linked to any personally identifiable information.

Cookies: I also use cookies — small text files sent to your computer — and web beacons to store certain information. Cookies may be used to authenticate your identity, determine if you are logged into my website, personalize your experience, provide security, serve targeted advertising, or analyze the performance of my website and services. For example, cookies allow me to recommend blog posts based on what you have read on my site in the past. I use cookies that are not specific to your account but are unique enough to help analyze general trends and usage, and to customize your interaction with my website. This information helps me understand how the site is used and to improve my website and services.

We may use any or all of the following types of cookies:

Essential Cookies: These cookies help me run my website and improve your experience. They may allow content to load more quickly or let you access “members only” or repeat-user sections of my website.

Functionality Cookies: These cookies allow me to remember your preferences from earlier visits to my website, including login information, so you do not have to enter the same information multiple times.

Social Media Cookies: These cookies let me record when you engage with a social media tool while visiting my website. For example, I may record that you have “liked” a certain part of my website. The social media application may also share data with me that you have allowed it to share. If you want to change your social media sharing settings, please visit the privacy settings of the social media network.

Advertising Cookies: I may work with third-party advertising partners who collect information about your browsing habits on my website to later show you relevant ads about my services when you visit third-party sites such as social media platforms. These cookies may also allow me to access your location.

When you first visit my website, you will be asked to consent to cookies. If you want to disable cookies, you can do so through your browser settings. However, disabling cookies may affect your ability to use the website or make purchases. More detailed information about managing cookies for specific browsers can be found on the browsers’ official websites. You can also learn more about cookies at What Are Cookies? By continuing to use my website without disabling cookies, you consent to my use of cookies as described in this policy.

Additionally, I may use third-party software to display advertisements on my website, manage marketing or email campaigns, or handle other business initiatives. These third parties may use cookies or similar tracking technologies. I do not control these third parties or their use of cookies. For more information about opting out of interest-based ads, please visit the Network Advertising Initiative Opt-Out Tool or the Digital Advertising Alliance Opt-Out Tool.

Pixel Tags: I may use pixel tags, which are small graphic files that allow me to monitor the use of my website and provide information about your interaction with it. These tags may collect your device’s IP address and browser type. Pixel tags are also used by my third-party partners to collect information when you visit my website, and I may use this information to display targeted advertisements.

Email Confirmations: I may receive email confirmations when you open an email from me. This helps me understand if users are responding well to my email communications and allows me to improve them.

Other Technologies: Other data technologies may be used to collect similar information for security, fraud detection, and related purposes. These technologies give me insights into your use of my website and help me improve my website and service offerings.

WEBSITE ANALYTICS

I may partner with third-party analytics companies, including Squarespace Analytics and Google Analytics. These companies may use cookies or other tracking technologies to analyze visitors’ use of my website or mobile app, helping to determine which content is popular and to better understand online activity. I do not transfer personal information to these third-party vendors. However, to access my website, you must consent to the collection and use of your information by these third-party analytics companies. You should review their privacy policies and contact them directly if you have any questions. If you do not want your information to be collected or used by tracking technologies, you can visit the Network Advertising Initiative Opt-Out Tool or the Digital Advertising Alliance Opt-Out Tool.

Google Analytics: You can opt out of having your activity on my website shared with Google Analytics by installing the Google Analytics opt-out browser add-on. This add-on prevents Google Analytics from collecting information about your visits to my website. For more information about Google’s privacy policy, please visit: https://policies.google.com/privacy

PROCESSING YOUR INFORMATION

For the most part, I do not process your information in-house but instead provide it to third-party processors for handling. For example, when PayPal processes your payment information, they act as a third-party processor. They process your payment and remit the funds to me. In many cases, it is necessary for me to transmit your information to third-party processors because I do not have the capability to perform these functions myself. More details on third-party processing are provided below.

However, I may occasionally process your data internally. The legal basis for this includes your consent to the processing, my need to conduct legitimate business interests, and compliance with legal obligations. When I process your information, it is to administer, maintain, and improve my website and offerings, enter into contracts with you, fulfill those contracts, keep records of transactions and interactions, provide you with goods and services, comply with legal obligations, obtain professional advice, and protect the rights and interests of my business, my customers (including you), and any third parties. I may process the following data:

  • Data associated with your account, such as your name, address, email address, and payment information.

  • Data about your usage of my website, such as your IP address, geographical information, and how long you accessed my website and what you viewed.

  • Data related to your personal profile, such as your name, address, profile picture, interests and hobbies, or employment details.

  • Data that you provide me in the course of using my services.

  • Data that you post on my website, such as comments or responses to blogs.

  • Data that you submit to me when you make an inquiry about my website or offerings.

  • Data related to your transactions with me, including your purchase of my goods or services. This may include contact details and payment information.

  • Data that you provide when you subscribe to my emails or newsletters, including your email address and contact information.

  • Data that you submit via correspondence, such as when you email me with questions.

  • Any other data identified in this policy, used to comply with legal obligations or to protect the vital interests of you or any other person.

INTERNATIONAL DATA

My website is hosted on servers located in the United States. Therefore, if you live outside the United States, some of your data will be transferred internationally to and stored on those servers. Additionally, I may use third-party processors (including payment processors) and subcontractors located in the United States. I use all reasonable methods to protect the safety of your data during transfer, including hosting my website on reputable servers and working with reputable third-party processors. By using this site and providing me with information, you consent to the transfer, processing, and storage of your information in the United States. Please note that privacy laws in the United States may not be as strict as those in other countries. Please be aware that:

  • I may transfer data I collect to locations outside of my headquarters for processing or storage, and this data may be processed by my staff or third-party processors. For example, I may engage third parties to fulfill orders. By submitting your personal data, you agree to this transfer, storage, and processing. I take all reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy.

  • Data you provide is stored on secure servers. Payment information and other sensitive data will be encrypted to protect its safety.

  • However, transmission of data over the internet is never completely secure, and I cannot guarantee the security of data sent to me electronically. Your transmission of data to me is at your own risk.

  • If the data you transmit is password protected, you are responsible for keeping your password confidential. You are solely responsible for any breaches of your data resulting from your disclosure of or failure to protect your password.

Customer data from outside the U.S. may be transferred to my website servers and/or third-party processors or subcontractors located in the U.S. I use Squarespace and Stripe, both of which actively participate in the U.S. Privacy Shield framework. The European Union has determined that companies participating in the U.S. Privacy Shield have adequate safeguards in place to protect customer data.

DATA RETENTION

I retain personal data as long as it is needed to conduct my legitimate business purposes or to comply with legal obligations, or until you ask me to delete your data. For example, I will retain certain personal information indefinitely to maintain your account, unless and until you delete your account. Data gathered for a specific purpose, such as assisting law enforcement or analyzing trends, will be kept no longer than necessary for that purpose. Data that is no longer needed for these purposes will be permanently deleted.

I will honor your request to delete your data as described below, unless I am legally required to retain access to it. However, I cannot control the retention policies of third parties. If you want any third parties, including those to whom I have transmitted your data, to delete that data, you will need to contact those third parties directly. You may request from me a list of all third parties to whom I have transmitted your data.

I may retain usage data—information collected by myself or third-party analytics companies to analyze website use—for internal analysis purposes. This type of data is usually kept for a shorter period than personal data, unless it is necessary to improve security or functionality of my website or services, or if I am legally required to retain it longer.

SECURITY OF YOUR INFORMATION

I take all reasonable steps to protect your personal data and keep your information secure. I use recognized online secure payment systems and follow accepted security standards to protect against loss or misuse of personal data. However, no security measure is completely foolproof, and no method of data transmission can be guaranteed against interception or misuse. I cannot guarantee the complete security of any information you transmit to me.

By consenting to this Privacy Policy, you acknowledge that your personal data may be available via the internet worldwide. I cannot prevent the use or misuse of your data by other parties.

I will notify you promptly of any known breach of my security systems or your data that might expose you to serious risk.

This website and mobile app are not designed for use by children under the age of 16. I do not knowingly collect personal data from anyone under 16. If you are under 16, please do not access or use my website or related products and services. If you become aware that I have collected data from anyone under the age of 16, please contact me so I can delete that data.

SENSITIVE DATA

I ask that you do not submit any sensitive data to me through public postings, email correspondence, or any other method. This includes social security numbers, health data, genetic data, or information related to your ethnic origin, religious beliefs, or criminal history. If you do send me this information, you are consenting to my use, storage, and processing of it in accordance with this privacy policy.

You have certain rights regarding your personal data, as outlined below. Please note that I may charge a reasonable fee for any actions you request related to your data.
